Additional Policy Information
This agency prohibits officers from engaging in racial profiling. The prohibition against racial profiling does not preclude the use of race, ethnicity, or national origin as factors in a detention decision by an officer. Race, ethnicity, or national origin may be legitimate factors in such a decision when used as part of a description of a suspect or witness for whom an officer is searching.
After an investigation, any officer or employee who is found to be in violation of this policy by engaging in racial profiling shall be subject to corrective action. Such action may include written reprimand, diversity and sensitivity training or other training that may be appropriate, counseling, time-off (paid or unpaid), suspension, or termination from the agency. Any corrective actions will be determined by the chief of police.
Collection of Information
In every traffic / pedestrian stop, officers involved shall collect the following information: person's gender, person's race or ethnicity (as stated by the person, or if the person does not state, the person's race or ethnicity as determined by the officer to the best of their ability), the offense committed, whether a search was performed (consent search or search with probable cause), if contraband found as a result of that search, if an arrest was made as a result of the stop, location of the stop, if a citation or warning was issued.
Data Basing Information Collected
Agency dispatchers shall enter all required information into the agency's in-house records management system for every traffic / pedestrian stop made by agency officers.
Annual Report to the City
Information stored in the agency's in-house record management system relating to racial profiling, shall be compiled in an annual report covering the period of January 1 - December 31 of each year and shall be submitted to the governing body of the City, no later than March 1 of the following year. The annual report shall not include identifying information about any individual stopped or arrested and shall not include identifying information about any officer of this agency.
